Marcy Hupp helps clients achieve their environmental and sustainability goals. She counsels companies on strategic business decisions, industry trends, and policy matters related to climate change; carbon offsets; climate disclosures; and other environmental, social, and governance (ESG) issues.
Marcy advises on corporate sustainability pledges and strategies related to emissions reductions; water use, discharge, and accessibility; and clean technology development. She regularly works with environmental professionals at manufacturing facilities to implement corporate sustainability goals through innovative emissions controls and water technologies.
With an LL.M. in sustainable international development, Marcy helps clients understand evolving climate change-related policies, environmental justice initiatives, and greenwashing risks. She has assisted with the development and implementation of clients’ initial ESG programs and contributed to sustainability reports. Marcy advises clients complying with Washington’s Climate Commitment Act and other emissions cap-and-trade systems. She has performed due diligence for transactions involving carbon offset projects and has assessed internal sustainability and human rights audit programs across supply chains.
Marcy also regularly counsels clients in environmental compliance and litigation matters. She assists with evaluating and mitigating risks arising under federal, state, and local environmental laws, including the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), Washington’s Model Toxics Control Act (MTCA), and the Clean Water Act. Marcy represents clients in federal and state courts and in mediation proceedings and defends clients against citizen suits.

Prior to joining Headwaters Law Group, Marcy was Senior Counsel at Perkins Coie LLP where she was co-chair of the Clean Technology Practice. Marcy earned her A.B. in Government, with honors, and History from Georgetown University and her J.D. (with a certificate in Environmental Law) from Tulane Law School. Most recently, Marcy earned her LL.M in Sustainable International Development from the University of Washington School of Law.
Under the Surface
A native Midwesterner, Marcy will always be in awe of the mountains of the Pacific Northwest. A former collegiate rower, Marcy is a competitive masters rower and a founding board member of the Pocock Rowing Club. She can also be found running on trails near Seattle, occasionally skiing, sometimes sailing, and definitely letting her husband carry their toddler on hikes.
